前两天发了个帖子问关于property management (PM) 把我的空调弄坏了的问题.后来找
了Department of Building and Housing （DBH）的人来看，DBH勒令他们检查。结果
PM通知我们，如果检查结果是插座没安错或者没有火灾隐患的话，就会让我们付钱。
而且他们还写信说，以后不管什么问题，除非是emergency，不许我们call他们，一律
只许写信。我们看闹到这个地步，只好搬家了。我们现在是month-by-month的lease
，我们星期一寄信说要7月31号搬家，结果他们只同意我们8月31日搬出。因为60天
notice，而且必须是月底。
给一个律师打电话,想咨询。可是律师说，你们这没多少钱，付咨询费都不划算，不如
就直接搬走算了。我说，搬走不会hurt我的credit history吗？律师说，他们会为了一
个月的房租跟你打官司吗？言外之意，没有法庭判决不会hurt我的credit。我想问问，
这是真的吗？
我们想上法庭告他们关于空调的事情。可不可以说，由于他们的negligence，给我的居
住环境带来危险，所以要提早搬走？

try other lawyers,
ofcouse they will sue you for one month rental, no kidding.

他们不一定sue，但可以report to hurt your credit

是啊，我也觉得这事没那么简单。
那我可不可以上法庭以“忽视房客安全”为理由要求提前break lease?

I think you can. The room you are living should be "LIVEABLE" at least. If
there is a safety concern, you should address it.
But what is liveable is subject to interpretation. If you can wait until the
end of Aug, that would be much simpler.
The other thing you want to try is to see if your school or employer has
some kind of legal assistance program. Usually it is free.

First thing you should do is to write a letter to PM to claim your rights
and state the reason that you are going to move out.

如果你不付最后一月的房租，他们肯定会去LANLORD-TENENTCOURT 告你，PM一般都有专
门雇的律师，去LT COURT告手续非常简单。这样你就比较被动了。
建议你去LT COURT 告这个公司，那里一般有LEGALAID，和实习的法学院学生，问问他
们怎么看你的案子，如果你的PM比较大，问问是否以前有过类似的住户投诉等。一般来
讲，LT COURT，是最普通的民事纠纷调解地，很多黑人没律师就自己上庭说，这种法
庭的法官会考虑到L T 两方的强/弱势传统，对T 在情感上一般会有所倾斜，也不会苛
求自辩的T有多少专业的法律知识。当然你自己准备工作要做足，拍照，保留证据，记
录电工和接电话的女人的名字，没有名字记录电话时间等。

is usa, city codes give tenants a lot of protection,
1. you dont need to move, you send them the same check each month, if they
deposit it, it means they continue to agree your tenancy. if they decline
it for 3 months in a roll, then they can go to court to obtain eviction
notice. then you normally get another 3 months rent-free residence.
2. since you have proff for sending out 3 rent checks, they can't do
anything to hurt your credit history. only the court can do it, not your
landlord!

你的lease是month by month，有contract吗？有的话仔细读读看有没有说明必须提前
60天的。我知道没有contract的情况下自动变为month by month，房东可以随时赶你走
，你可以随时离开。提前30天或者60天通知不是强制的。
这种小额纠纷没有律师愿意接，自己搞定就是了。

没有看懂你说的，为什么房东收了支票不去兑现？房东是不想让房客这个月走。
当然你的热心帮助还是要支持的。

谢谢大家的回复。
今天上午物业请的licensed electrician来了，显然物业是通过maintenance guy请的
。电工查了一下，说outlet没安错，是房子的power line有问题，不应该“send 240V
current to 120V outlet”，另外电线没有接地，他们就把power换到120V的了。其实
这对我们是一码事，反正就是outlet和输出电压不匹配，不是maintenance guy弄错了
，就是物业以前弄错了。电工既然是maintenance的朋友，就把责任推给物业了,这对我
们告物业倒没什么影响。
另外，dept. of Builing and Housing的人告诉我们，他让物业把所有的电路都查一下
，但是这个电工只看了一下那个outlet的。现在如果我们要提前搬出去的话，可不可以
以仍有隐患为由要求break lease呢？
对了，补充说明一下，我们当时一年lease结束的时候物业给我们一个文件，说是month
-by-month，并且60天notice，而且必须是在一个月的月底。我们签了字，所以如果要
早搬，只能上法庭争取了。

Landlord and tenant laws are different in different states. I think LZ
should read the specific of his/her state law.
But if there is signed contract saying it is month by month with 60 days
advance notice, LZ should follow the term to avoid potential lawsuit.

In the old building, usually there is a 240V outlet for an old
air conditioner, so, no way they run out of their mistake.
They should pay you the cost of that air conditioner,
go to the court, lawyer is not necessary, but good to have one,
in my city, they will charge $60-80 for a lawyer letter, and
$150-200 for a hearing ... ... In you case, no more then
two hearing will got the deal.
