最高检：无身体接触猥亵行为，等同于线下犯罪

10月27日，最高检第九检察厅厅长缐杰在新闻发布会上表示，2020年1月到今年9月，检察机关起诉成年人涉嫌利用电信网络侵害未成年人犯罪1.16万人。

对通过网络聊天胁迫女童自拍裸照等问题，最高检发布指导性案例，确立了无身体接触猥亵行为等同于线下犯罪的追诉原则，目前已累计追诉犯罪3000余人。

Chinese prosecutors charged 11,600 adults with using telecommunication networks to harm minors from January 2020 to September this year, the Supreme People's Procuratorate said on Friday.

In response to issues of public concern, including people coercing juvenile girls into submitting nude photos through online chats, the SPP issued case guidance establishing the principle that acts of online obscenity without physical contact were equivalent to offline crimes. Over 3,000 people have now been prosecuted under that principle.

检察机关通过自行补充侦查、适时派员介入重大疑难复杂案件侦查活动，深挖细查，有力指控犯罪。积极发挥侦查监督与协作配合机制作用，2022年以来，针对涉未成年人利用电信网络犯罪案件，纠正漏诉302人。

此外，检察机关对侵害不特定多数未成年人网络权益的提起公益诉讼。三年来，检察机关立案涉未成年人网络权益和个人信息公益诉讼案件524件。

最高人民检察院第九检察厅厅长缐杰表示，检察机关通过积极参与司法保护的全过程，综合运用刑事、民事、行政、公益诉讼“四大检察”职能，来维护未成年人的合法权益，同时依法推进未成年人网络保护治理。

Xian Jie, head of the SPP's ninth procuratorial office, told a news conference in Beijing that it had actively participated in the whole process of judicial protection of minors, and had used criminal, civil, administrative and public interest litigation powers to safeguard the legitimate rights and interests of minors.

Prosecutors had also carried out supplementary investigations and, when necessary, assigned personnel to participate in the investigation of major and complex cases, she said.

Since the start of last year, 302 people who had wrongfully escaped prosecution for infringing the rights of minors through telecom networks had been brought to justice.

为保障未成年人合法权益，国务院近日公布《未成年人网络保护条例》，该条例自2024年1月1日起施行。这是我国出台的第一部专门性的未成年人网络保护综合立法，重点就规范网络信息内容、保护个人信息、防治网络沉迷等作出规定。

Earlier this month, China's State Council released the new regulations to protect minors in cyberspace, which will come into effect on Jan 1, 2024. The document specifies efforts to regulate online content, protect personal information and prevent internet addiction among minors.

《条例》聚焦未成年人网络保护的突出问题。统计显示，截至2023年6月，我国网民规模已达10.79亿，未成年网民规模突破1.91亿。

“未成年人在通过网络便利和丰富学习与生活的同时，也面临着违法和不良信息侵害、个人信息泄露、网络沉迷、网络欺凌等诸多风险。保障未成年人在网络空间的合法权益，成为网络空间治理的一项重点任务。”国家网信办副主任王崧表示，条例回应了社会各界对未成年人网络保护的关切，标志着我国未成年人网络保护法治建设进入新阶段。

While minors benefit from the convenience provided by the internet, they also face risks such as exposure to illegal and harmful content, internet addiction and cyberbullying, said Wang Song, deputy director of the Cyberspace Administration of China.

To address these issues, the document includes an entire chapter dedicated to regulating online content, specifying the types of online information that are conducive to the sound development of minors, Wang noted.

条例将坚持社会共治作为未成年人网络保护的重要要求，规定了有关政府部门和学校、家庭、行业组织、新闻媒体等各方主体的责任，形成社会共治汇聚保护合力。

缐杰表示，检察机关将以条例的贯彻为契机，进一步加强检察司法保护，为未成年人营造清朗安全的网络环境。
