一、课程主题
本课程将全面分析“多方-多合同仲裁(包括涉及国家和公司集团的仲裁)”中出现的相关问题,以丰富的案例材料为基础,全面梳理法院和仲裁庭据以确定谁是仲裁条款当事人的理论、仲裁条款是否可扩展至非签署方、在多大程度上可以将通过多份合同参与单一经济交易的各方当事人纳入单一仲裁程序、被申请人是否可以将其他被告(无论是仲裁协议的知情人还是第三方)纳入仲裁程序、复杂合同结构的一方是否可以自愿介入仲裁程序、在何种情况下可以将单独的仲裁程序合并、如何以及在多大程度上可以克服同时进行几个仲裁程序所带来的不便,以及多方、多合同仲裁裁决的执行。

四、主讲人介绍
Bernard Hanotiau教授是布鲁塞尔和巴黎律师协会的成员。自1978年以来,Bernard Hanotiau教授作为当事人指定的仲裁员、主席、独任仲裁员、法律顾问和专家,在世界各地积极参与500多起国际仲裁案件。Bernard Hanotiau 教授是鲁汶大学(比利时)法学院的名誉教授和新加坡国立大学(新加坡)的客座教授。他是国际商事仲裁协会 (ICCA) 顾问委员会成员、国际商会(ICC) 协会理事会成员以及 ICC 国际仲裁委员会成员。他还是跨国仲裁协会(达拉斯)、伦敦国际仲裁院(LCIA) 和迪拜国际仲裁中心(DIAC)前副主席。他是新加坡国际仲裁中心(SIAC)、首尔国际仲裁中心和香港国际仲裁中心(香港)的顾问委员会成员。

I. Introduction
This course will discuss international arbitrations involve multiple parties or multiple contracts. It will address the following issues:
• theories on the basis of which courts and arbitral tribunals determine who are parties to the arbitration clause;
• whether an arbitration clause may be extended to non-signatories;
• to what extent one can bring to a single arbitration proceeding the various parties who have participated in a single economic transaction through several contracts;
• whether a respondent can join other defendants to the arbitration, be they privy to the arbitration agreement or third parties;
• whether a party to a complex contractual structure can intervene voluntarily in the proceedings;
• under what conditions separate arbitration proceedings may be consolidated;
• how and to what extent one can overcome the inconveniences that arise from having several parallel proceedings;
• enforcement of multiparty-multicontract awards.

IV. Lecturer Introduction
Professor Bernard Hanotiau is a member of the Brussels and Paris Bars. Since 1978, Professor Hanotiau has been actively involved in more than 500 international arbitration cases as party-appointed arbitrator, chairman, sole arbitrator, counsel and expert in all parts of the world.
Professor Hanotiau is Professor Emeritus of the Law School of Louvain University (Belgium). He is a member of the ICCA Governing Board and of the Council of the ICC Institute and a member of the ICC International Arbitration Commission. He is also a former Vice-President of the Institute of Transnational Arbitration (Dallas) and a former Vice-President of the LCIA Court. He is a member of the Court of Arbitration of SIAC and of the Governing Board of DIAC (Dubai). He is the author of Complex Arbitrations: Multiparty, Multicontract, Multi-issue (Kluwer, second condition 2020) and of more than 120 articles, most of them relating to international commercial law and arbitration. In March 2011, Professor Hanotiau received the GAR “Arbitrator of the Year” award. In April 2016, he also received the Who’s Who Legal “Lawyer of the Year” for Arbitration award.
