事情是这样的, 之前不是买了辆96年的马自达, 因为不懂车,看车前跟看车时都问卖家
车有没有什么大问题,她说没有,只有一个小的dent,不碍事.
后来发现abs灯亮,她说她去查过了,也没事的。
我们看engine时，她说她定期去保养用最好的package, 我问她有没有record，她说有
，如果到时我买会给我。
后来我们转了title,给了钱，她就把车钥匙，车的资料给我，然后说，因为搬家，现在
只有之前车主的保养记录和最近一次的保养记录。还叮嘱我一定要好好爱这车，要用最
好的油，什么都给它最好的。。。还说注意车子有时侯换档会抖一下，不过很快就没事
的。当时我也不知道那抖一下是什么意思啊，而且钱也给了，title也换了，既然她说
没事，但是要注意，那我就注意就好了，10几年的车，不可能什么问题都没有吧。
回来时在highway上开，开到半路，朋友说好象车子不能加速，怎么加油都上不去，所
以不得不停下来，警察过来问我们什么事。停了一下上路又没事了，但是果然发现车子
会抖一下。后来发现有一个灯亮，看了说明书后发现transmission有个hold gear的
button，想可能是这个问

You should have test driven the car before you buy it. you made a deal with
her by oral agreement. You can try if you have a strong witness. If you
could prove she lied about the problems of "abs灯亮,她说她去查过了,也没事的
。还说注意车子有时侯换档会抖一下，不过很快就没事的" and make the court
beleive she is a liar. You probably would win. You may ask an attorney to
see where your chance is.

'Some' States have lemon law, and lemon law are about new cars.
For private sale second-hand, the law is as-is.

lemon law is for car sold by dealer,
some state has lemon aid law for private transactions.

even a car is sold "as-is", if the seller knowingly hides
problems, s/he would be held responsible, and you have good
chance winning such a case. but the most important part is
you need to prove that she should know the problem. you may
want to have the shops write some statements for you.

Lemon Aid Law
New or used, purchased from dealer or private party, if a recently-purchased
vehicle fails to pass the state safety or emissions test, and if the
estimated cost of repairs is more than 10% of the purchase price, then the
Lemon Aid law comes into effect. The Lemon Aid Law grants consumers the
right to either cancel the contract for the purchase of the vehicle, or to
obtain a refund from the seller.

你请个好律师可能赢。。。。但是律师费比你车都贵。
你没有证据说人家不告诉你。你买车钱没有作mechanic check up???

我今年年初的时候，起诉了一家修车公司，
律师也请了，到现在还没有判呢，打官司是很漫长的。

当然要起诉他，就算赢不了也要恶心他一下。不太清楚律师费，上small court好像不
需要吧？反正在电视上没看到过，比如Judge Judy什么的。谁清楚，给大家普及一下？

Actually I watched one episode of Judge Judy exactly about buying a lemond
used car, and of course the buyer lost the case. I remember Judge Judy said
it very clearly, when you buy any used stuff, the default is AS-IS, meaning
when you take the deal, you accept the whatever condition the car is, unless
you have specific written agreement about anything that the seller is
responsible.
So, I don't think lz have a good case.

I went to buy the car with an American friend, he also asked when we saw the
lights on, and she said no big deal.
