on the conclusion, on behalf of the European Union, of a Protocol to the Agreement on the international occasional carriage of passengers by coach and bus (Interbus Agreement) regarding the international regular and special regular carriage of passengers by coach and bus

代表欧盟缔结的关于国际长途汽车和公共汽车定期和特别定期客运的《国际长途汽车和公共汽车临时客运协定》(以下简称：“《Interbus协定》”)的议定书

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 91, in conjunction with Article 218(6)(a) thereof,

Having regard to the proposal from the European Commission, Having regard to the consent of the European Parliament,

欧盟理事会，考虑到《欧盟运作条约》，特别是第91条及第218条6款a项，考虑到欧盟委员会的提议，考虑到欧洲议会的许可，

Whereas:

(1) In accordance with Council Decision (EU) 2020/1705(1)., the Protocol to the Agreement on the international occasional carriage of passengers by coach and bus (Interbus Agreement) regarding the international regular and special regular carriage of passengers by coach and bus (the ‘Protocol’) was open for signature between 23 October 2020 and 23 October 2022, s ubject to its conclusion at a later date.

鉴于：

(1)根据理事会决议（欧盟）第2020/1705号，《Interbus协定》关于国际长途汽车和公共汽车定期和特殊定期客运的议定书（以下简称为“议定书”）于2020年10月23日至2022年10月23日期间开放签署，并将于之后的某日缔结。

(2) The Protocol should facilitate the provision of the international regular and special regular carriage of passengers by coach and bus between the Contracting Parties to the Interbus Agreement (‘Contracting Parties’) and therefore give rise to improved passenger transport links between them.

(2)该议定书应促进提供《Interbus协议》缔约方（以下简称为“缔约方”）之间的国际定期和特别定期的长途汽车和公共汽车运输，从而使他们之间的客运联系得到改善。

(3) In order to facilitate the application of the Protocol, and in particular the operation of the Joint Committee established by Article 18 thereof, the Protocol largely mirrors the provisions established by the Interbus Agreement.

(3)为了方便议定书的适用，特别是其第18条所设立的联合委员会的运作，议定书在很大程度上反映了《Interbus协议》所规定的条款。

(4) In order for its benefits not to be excessively delayed, the Protocol provides for its entry into force, for the Contracting Parties that have signed and approved or ratified it, when three Contracting Parties, including the Union, have signed and approved or ratified it.

(4)为了不拖延签订议定书能带来的利益，议定书规定，在包括欧盟在内的三个缔约方签署并批准或核准议定书时，议定书对已签署并批准或核准的缔约方生效。

(5) Therefore, the Protocol should be approved on behalf of the Union,

HAS ADOPTED THIS DECISION:

The Protocol to the Agreement on the international occasional carriage of passengers by coach and bus (Interbus Agreement) regarding the international regular and special regular carriage of passengers by coach and bus, that replaces the Protocol to the Interbus Agreement which was open for signature between 16 July 2018 and 16 April 2019, is hereby approved on behalf of the Union (2).

已通过本决定：

第1条

兹代表欧盟批准，

《Interbus协定》关于国际长途汽车和公共汽车定期和特殊定期客运的议定书，取代2018年7月16日至2019年4月16日期间开放签署的《Interbus协定》的议定书。

The President of the Council shall designate the person(s) empowered to deposit, on behalf of the Union, the instrument of approval or ratification provided for in Article 20(2) of the Protocol, in order to express the consent of the Union to be bound by the Protocol.

第二条

理事会主席应指定授权代表欧盟交存议定书第20条第2款规定的批准书或核准书的人，以表示欧盟同意接受议定书的约束。

This Decision shall enter into force on the date of its adoption (3). Done at Brussels, 28 September 2021.
